4. Warranty. (to be read in conjunction with all clauses)
a) Warranty: the supplier warrants that all goods carry full, original
manufacturer's warranty of a minium 12 months, all goods to be free
from defects in material and workmanship when operated in accordance
with written instructions & good engineering practises for a
period of 1 year from receipt of goods.
b) General; in order to validate warranty it is the responsibility
of the owner/operator to ensure that regular backups of the video
files are carried out via the program if any system is connected
to the internet then warranty is null & void (remote access
allowed)-free telephone technical support throughout the rental
period installation is included in standard access ceilings-free
telephone technical support throughout the rental period
c) Exclusions; all Telstra charges and carrier fees-arrangement
of any of the above-any electrical works (power points etc)-electrical
supplier charges or fees-underground or interior wall conduits-telephone
point for modem-cable tray-connection to point of sale-conduits
or draw wires in walls-statutory authority charges. The installation
included is conditional upon easy access to the ceiling space and
room to work and does not include any extra charges from the installer.
Does not include ducting nor any special access or poles or external
work, there may be an extra charge on any special installation needs.
d) D.I.Y.; all DIY systems carry 1 yr RTB base warranty and is for
the DIY person we stress that you need to be aware of your local
laws pertaining to the installation; HawkRDS cannot and will not
be held responsible for incorrect or illegal installation.
e) Rental all rental systems are complete with the system as specified-including
1 “cam” consumer awareness monitor- on site warranty
for the length of the rental contract-rental systems are also Insured
for the term of the rental contract.
5. The devices offered for sale may not be used to violate the privacy
rights of others, or to access or intercept electronic communications
in violation of wiretap/eavesdropping/bugging laws. Phone tapping
and eavesdropping may be illegal in certain states. In no way will
HawkRDS or its subsidiaries or partners be held responsible for
inappropriate use of these products.
6. It is the sole responsibility of the buyer to consult the appropriate
entities who may have jurisdiction over the owning, installation,
use of or operation of, as well as legal counsel, for the interpretation
of any laws applicable to the area of intended use of these products.
7. It is a condition of sale that all conditions of sale that clauses
are to read in conjunction.
8. General: in this interpretation of this contract "supplier"
means GPf & associates & all brands, goods, services &
products sold, offered for sale or distributed by GPf & associates.
the customer means the person, firm, business or company to whom
the quotation or invoice is addressed & "goods" means
the goods specified on the price list, invoice or on offer. All
price lists, invoices or offers contained within, or on the face
hereof or to which this schedule is attached, or otherwise rendered,
are made by supplier & all orders are accepted by supplier,
(where expressed or implied) only on the condition the terms and
conditions of this contract shall apply. No term or condition contained
in the customer's acceptance or order or any other document related
to this contract shall add to amend or delete these items &
conditions or any of them unless agreed to in writing by the principal
of the supplier.
9. Payment: rental sales are first month’s rental plus $150.00
document fee. In the event of all moneys not being received by the
supplier, interest shall be charged at the rate of the monthly instalment
or 15% of the purchase price.
10. Delivery. Free into store.
11. Retention of title: property in the goods shall pass to the
customer only when the total invoice is paid. Invoice will have
been paid when any cheque or effects have been cleared. supplier
may at any time, recover the goods from the customer's possession
& resell the goods if any payment owed by the customer, on any
account is overdue & for this purpose, supplier, it's servants
or agents may enter upon the customer's or other premises upon which
the goods may be situated.
12. Cancellation by customer: once accepted by supplier, orders
cannot be countermanded, or delivery deferred or goods returned,
except, with the written consent of the supplier, upon terms that
reimburse and indemnify the supplier against all loss & freight
charges and other incidental expense, a re - stocking fee shall
also apply 30% of invoice.
13. Complaints: must be received within 24 hours with written confirmation
within 7 days.
14. Delay: if the supplier is prevented (either directly or in directly)
from effecting delivery or installation of the products, or any
part thereof by reason of strikes, trade disputes, lockouts, fires,
interruption of transportation, breakdowns, government action or
any cause whatsoever, (whether or not specified) or any event outside
the control of the supplier. The supplier will be under no liability
to the customer for any loss or damage arising either directly or
in-directly out of any such delay or non-delivery.
15. Liability: the supplier's liability is restricted to the replacement
of any goods supplied which have proved to have failed due to faulty
workmanship or materials & does not extend to any damage direct
or consequent upon such failure. The supplier is not liable in any
way whatsoever for goods misused or installed contrary to written
instructions or regulations.
16. Disclaimer: the supplier makes no warranties either expressed
or implied or statutory, including suitability and or merchantability,
beyond what is declared above. In no event shall the supplier be
liable in any manner for consequential or indirect damages including
but not limited to loss of profits, plant down time or suits by
a third party against buyer.
17. Acceptance: I have read, understand & agree to the trading
conditions I attest that any order placed on behalf of the company
or business stated below is covered by a personal & or personal
directors guarantee of payment. I warrant that I am empowered to
sign for and on behalf of the firm, business, and company.
